Jason Whiting, director of construction company JWB (Mersea) Ltd, Colchester, pleaded guilty at Chelmsford Crown Court this month to breaching section 37(1) of the Health and Safety at Work etc Act 1974. He was given a six-month custodial sentence, suspended for 2 years and required to do 240 hours of unpaid work.
His company, which was the principal contractor at a building site, also pleaded guilty to breaching Regulation 13(1) of The Construction (Design and Management) Regulations 2015 and was fined £1,000.
The prosecution followed as incident in July 2017 where roof trusses of a building under construction toppled over while being moved by a crane causing a worker to sustain serious injuries. Scaffolding had not been installed around and within the building.
