Under The Health and Safety (Fees) Regulations 2012, companies that the HSE consider are in material breach of any health and safety laws are liable for HSE’s related costs, including inspection, investigation and taking enforcement action.
If the HSE inspector considers the activity being carried out involves or will involve a risk of serious injury under the Health & Safety at Work etc Act 1974 (the HSWA) he/she may serve a notice to stop the activity in question or take some other action. We can advise on the validity of a notice, the effect of the notice on your business operations, and provide legal representation at any appeal to the Employment Tribunal.
Where the Health and Safety incident has resulted in a fatality there may well follow a Coroners' Inquest. Our Health and Safety Solicitors will be able to attend on your behalf of Interested Persons and ask relevant questions of witnesses.
