The action taken in the immediate aftermath of an incident can have a crucial impact on the outcome of a case. We offer an expert emergency response service to brief key staff, liaise with investigating authorities (the Police or Health and Safety Executive HSE) and put in place a communication network and sound response strategy. Our experienced Health and Safety Lawyers will provide the necessary legal support during this challenging time.
Internal Health and Safety Investigations must be handled appropriately otherwise they can take the incident from bad to worse. A professional investigation team is highly recommended as they will have knowledge of what to look for, who to speak with and what to ask. Collating and recording all the information is a key aspect of any investigation. Our document management systems are an invaluable asset even during these early stages.
It is important to know your rights whether you are being interviewed by the Police or a Health and Safety Executive (HSE) Inspector. Our Health and Safety Lawyers will be able to take you step by step through the process, advising on the powers that an Inspector has under Health & Safety at Work etc Act 1974 (the HSWA), and/or powers of the Police under the Police and Criminal Evidence Act. (PACE)
Under The Health and Safety (Fees) Regulations 2012, companies that the HSE consider are in material breach of any health and safety laws are liable for HSE’s related costs, including inspection, investigation and taking enforcement action.
If the HSE inspector considers the activity being carried out involves or will involve a risk of serious injury under the Health & Safety at Work etc Act 1974 (the HSWA) he/she may serve a notice to stop the activity in question or take some other action. We can advise on the validity of a notice, the effect of the notice on your business operations, and provide legal representation at any appeal to the Employment Tribunal.
Where the Health and Safety incident has resulted in a fatality there may well follow a Coroners' Inquest. Our Health and Safety Solicitors will be able to attend on your behalf of Interested Persons and ask relevant questions of witnesses.
If prosecution is unavoidable, our experienced Layers will give sound tactical advice on Basis of Plea, Defence, Mitigation and Penalties.
If the incident is of a serious public nature, there may well be a public inquiry. Fisher Scoggins Waters has represented clients at high profile cases such as the Public Inquiry into the Ladbroke Grove rail disaster and the Public Inquiry into the Dunblane shootings.
Fatal accidents in the workplace occur suddenly and unexpectedly. Those caught up in them often find themselves bewildered by what follows. Having helped businesses under investigation for corporate manslaughter, our Health & Safety specialists understand the impact such an investigation can have on a business and its people.
