Environmental Protection Dispute

The Environment Agency has the power to take a variety of enforcement actions against those it believes to be violating Environmental Law and thereby committing a criminal act.

If the Environment Agency considers you are in breach of environmental law, it has the following powers at its disposal:

  • To issue enforcement notice(s)
  • To issue prohibition notice(s) (where there is thought to be an imminent risk of significant environmental damage)
  • To vary, suspend or revoke an environmental licence
  • To carry out remedial works (the costs of which it will seek to recover)
  • To prosecute
