Commercial Flood Damage Disputes

Fisher Scoggins Waters' team has successfully acted for Commercial Clients across the country in Commercial Flood Damage claims, insurance indemnity disputes and recovery actions following floods to commercial premises.

Commercial Flood Damage

Burst water pipes and river banks are the most common, but quite often water damage is caused by less dramatic failures, such as poor property maintenance, defective workmanship and defective products.

Activated sprinklers can cause catastrophic losses to computer software and hardware, stock, plant and machinery damage, all of which are vital components which allow continued commercial trading.

Our Commercial Clients

Our experience and current Commercial Flood Damage claims includes:

  • Warehouses
  • Factories
  • High Street retailers
  • Office blocks
  • Hotels
  • Residential
  • Other Commercial premises

We can advise on policy coverage, and interim funding, liaise with loss adjusters and negotiate claims to ensure delays in returning to business are kept to a minimum.

Business Interruption Claims

We advise on business interruption coverage. For situations such as those seen in Cumbria and more recently in the Thames Valley where towns were entirely closed due to flood water, questions are raised as to coverage. We can advise you on coverage issues.

Where business interruption losses flow from an insured peril (i.e. flood) accurate measurement of loss sutained can be one of the most complicated and contentious elements of a claim to assess and settle. We instruct and work with forensic accountants to analyse initial business interruption loss reserves, calculating actual loss sustained, loss of production and/or sales, advise on mitigation and expediting expenses.

Commercial Flood Damage Solicitors

Our Commercial Flood Damage Solicitors have expertise in relation to property policies covering damage to property caused by named perils and understand issues arising under such policies, including policy construction and the full range of conditions (conditions precedent) and policy exceptions; for example, notification, wilful default and fraudulent claims.
