Enforcement is about making sure that rules, standards, court orders or policies are properly followed. The HSE says that its emphasis is on prevention but, where appropriate, it will enforce the law where it has been deliberately flouted. Following the Definitive Guideline for sentencing health and safety offences, we have seen an increasing number of large fines of £1m or more, and more companies are facing higher penalties in the future. But do these very large fines really improve safety, and act as a deterrent so safety is taken more seriously? If enforcement is about making sure rules and laws are properly followed, maybe there are other avenues that should be explored.
