An employee received a serious electric shock when the spade he was using struck a post hole, leading to an investigation into the health and safety standards of the company he worked for by the HSE. The employee was lucky to escape serious injury as the Court was informed that the incident could have been fatal.
At the hearing on Friday 18 September 2015 Berneslai Homes Ltd which is based at Gateway Plaza, Barnsley, was fined £7,500 with £8,562 in costs after pleading guilty to a breach of the Electricity at Work Regulations 1989, regulation 4(3). The investigation found that safety procedures were inadequate and no risk assessment was carried out prior to the excavation proceeding.
